So I got the newest news on my sons case and what the guy is facing. Nothing really. Another try at a ticket which will mean he gets his license suspended and a fine up to 1000 dollars. Now tell me this is the stature::

782.071 Vehicular homicide.—“Vehicular homicide” is the killing of a human being, or the killing of a viable fetus by any injury to the mother, caused by the operation of a motor vehicle by another in a reckless manner likely to cause the death of, or great bodily harm to, another.


The bolded part...would running a red light which was red for 25-30 seconds at 52 miles in a 45 mph zone seem to fit that defenition to you?


Because I was told today that in order to charge for Vehicular Homicide the threshhold for proving he was reckless the speed needs to be at least 20 mph over possibly as much as 25-30 even!! Am I the only one thinking in areas where speed is already up to 65 or 70 that if they were driving 90-100 mph they could obliterate a smaller car if they had a truck or SUV??

Just an FYI most speeds in Orlando are 45 downtown it is 30. 20 over down there is a normal speed. You go a little east of where I live or I-4 or I-95 and they have speeds of 75 or 80 in some places!! So they have the speeds that high and some does 10/20/30 over they could me over 85-110 mph. I really was shocked when she told me that It is crazy to think a semi truck could be driving through here and doing 10 miles over the speed limit and runs a red light. He would obliterate anyone in that car. Guaranteed.

I would hope that just the fact of running a RED light would be RECKLESS DRIVING, regardless of the speed. But, I know this isn't the case. Sadly.

People need to wake up and quit being idiots while driving!

20MPH over the limit is reckless here. 10MPH is about the point when you might get a ticket. I don't think the cops in the speed traps pull out for less, mostly because the fines are sliding scale & less than 10MPH is like a $25 fine while 19MPH is $178

But running a red light ought to be reckless on it's own regardless of speed, especially if traffic from the cross direction has already started to move. Plus any accident that ends in the death of someone also ought to be considered reckless as well regardless of the circumstances/speeds involved. If someone dies because of your driving, you were driving recklessly in my book.

I think it is reckless to drive over the speed limit at all and definitely to run a red light or stop sign. I think the rules are there for a reason, and it is reckless to be breaking any of them - it could be life or death.
