Default we just had an accident

My husband and I were going to go see about his cousin (posted earier today about this) and on the way there some idiot ran into us at a red light doing about 30 miles an hour. He didnt want to call the police because there was not alot of damage but my husband was hurt (back, shoulder and neck pain) and said no he needed an accident report so he unwillingly called and then when the highway patrol officer gets to the scene the guys story changed and said we backed up into his car and the cop believed him. Well he claims he doesnt take sides but he did not issue a ticket for it and he asked my husband if he had anyone to corroberate his story but unfortunately there was only him, our son and me in the car at the time. In his car was just him and his wife. Not sure what we are going to do now because my husband has to go to a doctor and if the insurance companies believe his lies then we will be stuck paying for more medical bills when the accident was not his fault (he had an accident a few years ago where a boy ran a stop sign and did not have suffiecient insurance and we went through our policy and his policy and is still paying for that)

Oh, I am so sorry this happened! I hope your husband isn't hurt too badly. And, so sorry that you have to deal with this guy on top of it all! Major P and PT being sent your way.

yea and we still have not been able to get into touch with anyone who has any information on his cousin. We had heard she was being tranferred to a psychiatric hospital so Im guessing that means that the injuries cannot be to bad because other wise they would keep her in intensive care I would think. I dont know though. Right now my husband is trying to call the insurance company and all that and we only have one phone to use.

Im hoping too. I was not hurting to bad at the accident but now my shoulder and neck and upper back are starting to get really stiff

How old is your son? Was he in a carseat? Even in a low impact car accident, the car seat can be damaged (not to the human eye) and could be replaced. there is much talk about whether in a minor accident if this needs to happen. carseat replacement info

I'd talk to the insurance company to see what they say especially since you and hubby are feeling a bit stiff and out of whack.

If you are getting stiff, watch yourself tomorrow, you might have whiplash which often shows a while later.

Second, yes, contact your insurance right away and see what kind of advice they have. You might need to look into a lawyer, too, if this guy is gonna lie. I am guessing he has had other accidents and that's why he didn't want cops and insurance involved. I was in an accident when I was younger where the lady pulled out of an alley and slammed into me. Clearly it was her fault, but she wasn't given a ticket. They still deemed the accident her fault and her insurance paid for it. Good luck!

He is 11...he is about 5 ft 3 and 140 pounds so he is to big for the carseat. It all happened so fast I am not even sure if the seatbelt caught or not. Luckily he didnt set the airbags off or our car would have been totalled. My husband does body work so whatever damage there is he can fix so that isnt a big deal. He said he thinks there is damage to the frame but he hasnt checked it yet.

What a day you've had . No doubt you were already tense body wise with his cousin's status and this made it far worse, so the effect probably doubled it. Hopefully the insurance inspection will prove you right. Take care of yourselves today.

Oh my goodness, I"m glad you're all fairly alright and it wasn't worse. What a butthead to change up his story....typical huh. Hopefully things will go you way with the legal and insurance stuff.

That bites! In Texas if you are hit from behind 99% of the time it is deemed the fault of the person in the back. Even if say, you were on a hill and you drove a standard so you rolled back on take off and hit the person behind you - it would be their fault. I was hit from behind a year ago and that guy admitted it but was not issued a ticket. Good luck! Seriously, what reason would your husband have to be going backwards down the road - what a dumb lie on that guys part!

You really have had a heck of a day, haven't you? I'm sorry all of this is happening. I do recommend you speak with your insurance and an attorney ASAP! Especailly since both of you are feeling pain/stiffness. I hope everything works out and that his cousin is ok. {{{{hugs}}}}
